New legislation now allows IP holders to claim fixed damages for infringement—up to around $29,000 per violation. This strengthens protection for rights holders, especially in online enforcement and domain name disputes.

This development marks a significant shift in Uzbekistan’s intellectual property enforcement landscape. Prior to the amendment, rights holders often faced challenges in quantifying actual damages, making litigation unpredictable and, at times, ineffective. The introduction of statutory compensation provides a clear and efficient remedy, streamlining the legal process and offering more certainty for businesses and creators seeking to protect their IP.
Moreover, the legislation is expected to bolster foreign investor confidence in Uzbekistan's IP framework. By aligning more closely with international best practices, particularly those in the U.S. and EU where statutory damages are a norm, Uzbekistan signals its commitment to fostering innovation and protecting the creative economy. This change may also lead to increased scrutiny of infringing activities online and a rise in IP litigation as rights holders become more empowered to act swiftly against violators.
